VENICEPLACE
RENTAL PROPERTY LEASE AGREEMENT

Between
1. Owner: [Veniceplace]
and
2. Tenant: [name]
Owner
hereby leases to Tenant, and Tenant leases from Owner, the
rental property hereinafter
described
as "Venice Place" under
the following terms and conditions:
RENTAL PROPERTY
Venice Place is a one-bedroom guest house. The rental property
has one bedroom, one bathroom and an open floor plan kitchen
and living room area on approximately 660 square feet of living
area. It is fully furnished including bed and bathroom linens,
kitchen dishes, pots, utensils and tools (see inventory list
attached).
LEASE PERIOD
This lease shall commence on [arrival date not before 4 pm] (the
check-in time) and shall continue until [departure
date not later then 11am] (the check-out time), unless terminated at
an earlier date in accordance with the provisions of this lease
dealing with default or unless extended to a later date with
the written consent of both parties.
RENT
The Tenant shall pay the Owner rent in the sum of [total
amount of rent]. This includes a weekly cleaning fee
of $60. The entire rent is due upfront. The Owner accepts cash,
personal checks,
wires, money orders. Owner accepts personal checks only from
the US and with printed address and corresponding State ID
card, passport or drivers license which state the same address.
Credit card payments can not accepted.
Tax
For stays 30 days and under the rate is subject to 14% city occupancy taxes.
RESERVATION
Payment of the Security Deposit is due upon reservation. If the
check-in date is in less than 14 days from the date of this
lease agreement, tenant has to provide owner with credit
card details in order to confirm for the reservation. Security Deposit
and first week’s rent have to be paid in cash, money
order, cashiers check, personal check. Credit card payments
can not accepted. Owner accepts personal checks only from
the US and with printed address and corresponding State ID
card,
passport or drivers license which state the same address.
SECURITY DEPOSIT/CREDIT CARD
The Tenant agrees to pay to the Owner a security deposit of $1,500
(one thousandfivehundred), due in full at the time of reservation. Instead
of a Security Deposit tenant can also provide his credit
card details to the owner. A security deposit will be returned
by to Tenant within 14 (fourteen) days following Tenant’s
vacating the Rental Property, minus any costs to repair or
replace any damage or loss to the Rental Property or the contents
thereof. The Owner may retain all or part of the deposit or
charge the submitted credit card for compensation for any damage
or violation of the terms and conditions of the lease agreement.
CLEANING
Each property will be inspected and cleaned weekly on a business
day between 9.00 am and 7.00pm. The rental fee will provide
for four hours of normal cleaning. If additional cleaning is
required, appropriate charges will be deducted from the Tenant’s
security deposit at the rate of $25 per hour. It is the tenant’s
responsibility to ensure that the Rental Property is vacated
in a clean and tidy condition.
KEYS
The tenant will receive one set of front door keys on check-in.
There is a $25 fee for any lost keys.
MAXIMUM NUMBER OF PEOPLE
The rental property has a maximum occupancy limit of two persons.
Any further occupants will be considered as over occupancy.
Over occupancy is considered a serious violation of this rental
agreement.
PETS
Pets are not allowed in the rental property.
SMOKING
Smoking is not allowed in or around the rental property. The tenant agrees that for every non-smoking violation the owner will charge a minimum $250 cleaning fee of tenant’s security deposit.
FILMSHOOTING
There is absolutely no film or photo shooting and related activities as for example castings, make-up or production meetings permitted on the premises of VenicePlace without owner’s prior written consent. The tenant agrees that for every violation of this clause the owner will charge a minimum $2,500 fee of tenant’s security deposit.
QUIET TIME
11:00 pm to 7:00 am. Please respect these hours for everyone's
enjoyment.
LIABILITY RELEASE
The Tenant agrees and does hereby release from liability and
to indemnify and hold the Owner harmless. This release is for
any and all liability for any personal injuries (including
death) and/or any property losses or damage occasioned by,
or in connection with any activity or accommodation related
to the lease of the rental property. Any legal disputes arising
under this Agreement shall be mediated through arbitration
and subject to the rules of the American Arbitration Association
at the branch office closest to Venice, California.
RULES TO PREVENT DAMAGE
To prevent damage to the rental property the Tenant agrees to
abide by the following:
Hardwood Floors
No water spillage allowed on the hardwood floor. No floor cleaning
with water or any other product other than the wood maintenance
cleaner provided by the Owner. Any water spillage has to be
removed immediately.
No sharp-edged objects without protection on the hardwood floors.
Countertops
No sharp-edged or hot objects without protection on the Corian
kitchen counter tops.
Fireplace
No burning of anything other than gas in the fire-place. The
fireplace can not handle wood or other materials and will become
an instant fire hazard.
The key to the fireplace’s gas valve has to remain OFF
at all times except for when the fireplace is lit. During the
times the fireplace is lit the Tenant must watch the fireplace
frequently and closely. Before going to bed or leaving the house
the Tenant must switch the gas valve to off.
Barbeque
No BBQing is permitted on the premises of the rental property.
Disfunctional Appliances and other defects
Tenant agrees to inform Owner as soon as possible about any dysfunctional
appliances, such as water heater, washer, dryer, refrigerator,
ovens or any defects in the electrical and plumbing system
as well as roof and windows.
Neighbors
The rental property is in a quiet residential neighborhood. The
Tenant agreed not to undertake any activities which could interfere
with their neighbors' right to quiet enjoyment of their property.
TENANTS LIABILITY
The Tenant agrees to properly use and operate all furnishings,
including electrical and gas appliances, plumbing fixtures,
electronic home entertainment systems, fireplace and all other
items provided during the stay. Tenant agrees to accept liability
for any damages caused to the property (other than normal wear
and tear) by Tenant or Tenants guests, including, but not limited
to, landscaping and misuse of appliances and equipment furnished.
The Tenant also agrees to leave the home so that no extraordinary
housekeeping other than four hours of normal house cleaning
will be required after the Tenant’s departure. The Tenant
agrees to both notify and reimburse the Owner of all necessary
and reasonable repairs, or damage or destruction of property
caused by the Tenant and the Tenant’s guests, or for
extra cleaning required. The Owner will notify the Tenant of
the costs of damages or extra housekeeping within ten days
of the Tenant’s departure. The Tenant stays fully liable
for any and all costs of damage exceeding the amount of the
security deposit and agrees to reimburse the Owner for such
costs without delay.
CANCELLATION
Should the Tenant wish to cancel this reservation, notice of
cancellation MUST BE IN WRITING AND RECEIVED MORE THAN 120 DAYS
PRIOR TO CHECK IN DATE. Cancellations notices received more than
120 days prior to check-in will be refunded by the owner, less
a $100 cancellation fee. If the Tenant’s notice of cancellation
is received less than 120 days prior to the check-in date, the
Tenant will forfeit all sums paid, except the security deposit,
unless the Owner is able to re-rent the property to someone else,
at the same rate, for the same period. If the property is re-rented
the Owner will only charge the $100 cancellation fee.
ADDENDUM: Inventory list
