LEASE AGREEMENT TERMS & CONDITIONS
 

Property management hereby leases to renter, and renter leases from Property management, the aforementioned rental property under the following terms and conditions:

Rental property
The property is a one-bedroom guest. The rental property has one bedroom, one bathroom and an open floor plan kitchen and living room area on approximately 600 square feet of living area. It is fully furnished including bed and bathroom linens, kitchen dishes, pots, utensils and tools

Renter accepts responsibility to properly maintain said property during occupancy and agrees to replace or repair and pay for any breakage, damage, or loss caused by Renter or Visitors of Renter during occupancy, other than normal wear and tear.

Inventory list
The attached inventory list is part of this lease agreement. Renter agrees to verify type and number of listed items and to notify property management of any discrepancy. Renter agrees to pay property management for any missing or damaged items, within 10 days after being notified by property management. Renter agrees to accept property management's notifications by mail, fax, email or phone.

Lease period
The lease agreement ends on the aforementioned check-out date at the aforementioned check-out time, unless terminated at an earlier date in accordance with the provisions of this lease dealing with default or unless extended to a later date with the written consent of the property management.

Late check-out not possible
A late check-out is not possible due to other guests arriving and the required room cleaning in-between guests. For a check-out later than 30 minutes after the aforementioned check-out time (usually 11.00 am) property management will charge renter the nightly cost for a luxury hotel suite in a Santa Monica Beach resort plus a $100 handling fee of renter’s security deposit. Renter agrees to have the rental property inspected by property management for damage and missing inventory at the time of check-out.

Down payment at the time of reservation
Property management reserves the right to charge renter's credit card at the time of the reservation confirmation for a non-refundable down payment in the amount of $100.00. Property management usually does not charge renter’s credit card before arrival.

Rent payment terms
The entire rent is due upfront. Property management accepts cash, personal checks, wires, money orders.
Property management accepts personal checks only from the US and with printed address and corresponding State ID card, passport or drivers license which state the same address. Credit card payments are subject to a 4% processing fee.

Accepted credit cards
The following credit cards are accepted: American Express, VISA, MasterCard. Renter understands and consents to the use of the credit card provided without original signature on the charge slip, that a photocopy or fax of this agreement will serve as an original, and that any credit card authorization cannot be revoked and will not terminate until 14 days after leased premises are vacated. Renter further agrees that in the event the credit card becomes invalid, renter shall owe property management the above stated rent amount and if applicable the above stated security deposit, which shall be immediately due and payable to property management.

Security deposit
The renter agrees to pay property management the aforementioned security deposit, usually $1,500. The security deposit is due 30 days before arrival date and is usually not charged but simply an authorized hold on renter’s credit card account.

Deposit return
Any remainder of the security deposit will be returned to renter within 14 (fourteen) days following renter’s vacating the rental property after all terms and conditions of this agreement are satisfied, minus any costs to repair, extra cleaning or replace any damage or loss to the Rental Property or the contents thereof. Property management may retain all or part of the deposit for compensation for any damage or violation of the terms and conditions of the lease agreement. If renter cancels less than 30 calendar days before check-in, renter will forfeit the security deposit.

Fee for returned checks
Renter agrees to pay a $40 fee for every returned check.

Fee for credit card payments
Renter agrees to pay a 4% processing fee for credit card payments.

Early departure
There are no refunds for early departure.

Cleaning terms
The rate includes cleaning after your departure. The property will be inspected and cleaned on a business day between 11.00 am and 4.00 pm after renter’s departure. The rental fee will provide for four hours of normal cleaning. If additional cleaning is required, appropriate charges will be deducted from the renter’s security deposit at the rate of $40 per hour. It is the renter’s responsibility to ensure that the rental property is vacated in a clean and tidy condition.

Keys to be left inside upon departure
All keys are to be left on the kitchen countertop upon departure.

Lost key fee
The renter will receive one door key for all doors and gates upon check-in. There is a $50 fee for each lost key.

Stained towel fee
Renter agrees to always hang the provided bath, hand and face towels onto towel hooks, towel bars or store them in the closet. Renter agrees not to use towels for anything that might damage or stain them as for example: house cleaning, make-up removal, shoe cleaning or leaving them on the floor. Renter agrees to be charged out of his/her security deposit at a rate of $25 per damaged or stained towel.

Occupancy maximum two persons
The rental property has a maximum occupancy limit of two persons. Any further occupants will be considered as over occupancy, unless property management provides written consent. Oral consent is not sufficient. Over occupancy is considered a serious violation of this rental agreement. In case of over occupancy property management will charge a minimum $500 fee of renter’s security deposit or from renter’s credit card and has the right to terminate the rental agreement immediately.

Absolutely no pets
Pets are not allowed in the rental property. Guests who bring a pet or pets without written approval by the property management will forfeit their security deposit and may be evicted from the property. The renter agrees that for every violation of this clause property management will charge a minimum $500 cleaning fee of renter’s security deposit.

Expenses for pay television
Renter has access to premium and on demand television channels through the use of the Verizon FiOS cable box. Renter agrees to notify property manager upon departure in writing of any ordered TV products during occupancy. Renter agrees to have his/her credit card charged for all TV products ordered during occupancy. All orders are automatically being registered by the cable box serial number.

No smoking
Smoking is not allowed in or around the rental property. The renter agrees that for every non-smoking violation property management will charge a minimum $250 cleaning fee of renter’s security deposit

Special caution with all fireplaces
The use of a fireplace requires extra caution. The Renter agrees to make himself familiar with the location and the function of the fire extinguishers before lighting a fire, to make sure the exhaust flute is opened before lighting a fire, to never leave a fire burning unattended and to always switch of the gas valve completely after using the fireplace. In case of an emergency call 911.

Fireplaces are gas-only
No burning of anything other than natural gas in the fireplace is allowed. The fireplace can not handle wood or other materials and will become an instant fire hazard. The key to the fireplace’s gas valve has to remain OFF at all times except for when the fireplace is lit. During the times the fireplace is lit the renter must watch the fireplace frequently and closely. Before going to bed or leaving the house the renter must switch the gas valve to off.

Fire extinguisher
The rental property is equipped with at least one fire extinguisher, which is stored in the kitchen cabinet or/and in the closet area. Renter agrees to make himself familiar with the location and the function of the fire extinguishers.

No film shooting
There is absolutely no film or photo shooting or related activities as for example castings, make-up or production meetings permitted on the premises of the property without property management’s prior written consent. The renter agrees that for every violation of this clause property management will charge a minimum $2,500 fee of renter’s security deposit.

Neighbors
The rental property is in a quiet residential neighborhood. The renter agreed not to undertake any activities which could interfere with their neighbors' right to quiet enjoyment of their property.

Quiet time
11:00 pm to 7:00 am. Please respect these hours for everyone's enjoyment. House parties are strictly prohibited and grounds for immediate eviction.

Rules to prevent damage
To prevent damage to the rental property the renter agrees to abide by the following:

(A) Hardwood Floors
No water spillage allowed on the hardwood floor. No floor cleaning with water or any other product other than the wood maintenance cleaner provided by property management. Any water spillage has to be removed immediately. No sharp-edged objects without protection on the hardwood floors.

To prevent scratching the floor, do not drag your luggage across the floor.

(B) Countertops
No sharp-edged or hot objects without protection on the Corian kitchen counter tops. Do not use steel wool, abrasives, or harsh cleansers. They may damage the finish. Do not move pots or pans horizontally over the countertop.

(C) Tempered glass cook top surfaces (CERAN)
To clean tempered glass surfaces follow these steps:
Remove grates, wash, wipe with clean water, and dry thoroughly.

Use nonabrasive, plastic-scrubbing pad on heavily soiled areas. Do not use steel wool, abrasives, or harsh cleansers. They may damage the finish. Do not move pots or pans horizontally over the cook top

Renter will be charged for following excessive use

(1) Stains in bed sheets, linen, bath towel or kitchen towels that were not there when renter arrived and that do not come out by regular chlorine-free eco laundry washing including a treatment of chlorine-free stain remover.

(2) Dirty dishes should be put into the kitchen sink or (if available) into the dish washer. If dirty plates, silverware or pots etc are found in the cabinets that were not there when renter arrived renter shall be charged for extra cleaning.

(3) Renter should take out the trash from the kitchen, any food remains, dirty bottles and everything that could cause odor, insects or mold.

(4) Renter shall be charged for extra cleaning of excessive body grime and suntan oils left in bath tub or shower, which could have been rinsed out at the time of use.

(5) Renter shall be charged for extra cleaning of baked-in boil-overs in the oven and on the cook top.

(6) Spots, stains and scratches on the floor, on the rugs, on floor mats and on furniture that were not there when renter arrived.

Not permitted
Not permitted on the premises of the rental property is the following: Grilling, barbecue, open fire, fire crackers, fire works, lighting candles without a functioning candle holder.

Dysfunctional appliances and other defects
Renter agrees to inform property management as soon as possible about any dysfunctional appliances, such as water heater, washer, dryer, refrigerator, ovens or any defects in the electrical and plumbing system as well as roof and windows.

Force majeure
There may be circumstances beyond the control and contemplation of property management, in which the property might not be available for renter’s occupancy. Examples of these include (but are not limited to) destruction of or severe damage to the property. In the event of Force Majeure, property management will attempt to make alternative arrangements for renter where possible. If this is impossible, or if the alternative arrangements are not acceptable to renter following common sense, then property management will refund all monies paid. This will be the full extent of our liability to you in such circumstances, and we will not be responsible for any other costs connected with any such cancellation, howsoever arising.

Cancellation
Should the renter wish to cancel this reservation, notice of cancellation MUST BE IN WRITING AND RECEIVED MORE THAN 30 DAYS PRIOR TO CHECK IN DATE. Cancellations notices received more than 30 days prior to check-in will be refunded by property management, less a $100 cancellation fee. If the renter’s notice of cancellation is received less than 30 days prior to the check-in date, the renter will forfeit the security deposit, unless property management is able to re-rent the property to someone else, at the same rate, for the same period. If the property is re-rented for the same or a higher rent amount property management will only charge renter the $100 cancellation fee.

Renter's liability
The renter agrees to properly use and operate all furnishings, including electrical and gas appliances, plumbing fixtures, electronic home entertainment systems, fireplace and all other items provided during the stay. Renter agrees to accept liability for any damages caused to the property (other than normal wear and tear) by renter or renter’s guests, including, but not limited to, landscaping and misuse of appliances and equipment furnished. The renter also agrees to leave the home so that no extraordinary housekeeping other than four hours of normal house cleaning will be required after the renter’s departure. The renter agrees to both notify and reimburse property management of all necessary and reasonable repairs, or damage or destruction of property caused by the renter and the renter’s guests, or for extra cleaning required. Property management will notify the renter of the costs of damages or extra housekeeping within 14 (fourteen) days of the renter’s departure. The renter stays fully liable for any and all costs of damage exceeding the amount of the security deposit and agrees to reimburse property management for such costs without delay.

Liability release
The renter agrees and does hereby release from liability and to indemnify and hold property management and / or property owner harmless. This release is for any and all liability for any personal injuries (including death) and/or any property losses or damage occasioned by, or in connection with any activity or accommodation related to the lease of the rental property. Any legal disputes arising under this agreement shall be mediated through arbitration and subject to the rules of the American Arbitration Association at the branch office closest to Venice, California.

II hereby agree to abide by all the above conditions of this 3 page lease agreement and verify that all my personal information given at the time of reservation is true and correct.
